One important thing that we need to think about would be the use of a PJC for a person who has a CDL. A person who has a CDL could hire an attorney and that attorney could accidentally go into court and obtain a Prayer for Judgement Continued on a speeding charge that was eligible. However, the DMV would not recognize that PJC because of the fact that CDL holders, commercial drivers, are not eligible to use a PJC under their specific license provisions. Attorneys have to be very careful when reviewing clients’ driving records to make sure that they look for an indication that the defendant has a Commercial Drivers License. If you have a CDL, a PJC cannot be an option for resolution.
